TERMS OF SERVICE

These terms apply to purchases of goods through shop.schoolfitnessireland.com (the “Store”). The Store is operated by School Fitness Ireland (“School Fitness Ireland”, “we”, “us” or “our”). You can contact us at office@schoolfitnessireland.com or 021 2120439.
These terms apply to online product sales. Separate terms may apply to coaching programmes, camps, bookings or other services.
1. USING THE STORE
By using the Store or placing an order, you agree to these terms, our Return and Refund Policy, Shipping Policy and Privacy Policy. You must provide accurate, current and complete information and must not misuse the Store, interfere with its operation or use it for unlawful purposes.
2. PRODUCTS AND INFORMATION
We take reasonable care to describe and display products accurately. Colours and appearance can vary by screen, and minor variations may occur. Measurements are approximate unless stated otherwise. Product availability is subject to change.
Please review product descriptions and suitability before ordering. Sports, fitness and school equipment must be installed, maintained and used in accordance with supplied instructions, age guidance and appropriate adult supervision. This does not limit our obligations regarding product safety or conformity.
3. ORDERS AND CONTRACT FORMATION
Your order is an offer to buy. An automated order acknowledgement confirms receipt but does not necessarily mean the order has been accepted. A contract is formed when we confirm dispatch or otherwise expressly accept the order.
We may refuse or cancel an order before acceptance where a product is unavailable, information or pricing contains an obvious error, payment is not authorised, delivery is unavailable, or we reasonably suspect fraud or misuse. If payment has been taken for a cancelled order, it will be refunded.
4. PRICES, TAXES AND PAYMENT
Prices are shown in euro and include VAT where applicable unless clearly stated otherwise. Delivery charges and any other applicable charges are displayed at checkout before payment. You authorise us and our payment providers to charge the selected payment method for the total shown at checkout.
5. DELIVERY
We deliver to destinations and by methods made available at checkout. Delivery dates are estimates unless we expressly agree a guaranteed date. Please provide a complete delivery address and a daytime contact number, especially for bulky goods. Risk in consumer orders passes when the goods are delivered to you or a person you nominate. 6. CANCELLATIONS, RETURNS AND REFUNDS
Consumer cancellation rights, return instructions, exclusions and refund arrangements are set out in our Return and Refund Policy. For change-of-mind returns, the customer pays the direct return cost. If goods are faulty, damaged, incorrect or not as described, School Fitness Ireland will arrange the return or reimburse reasonable return costs in accordance with applicable law.
7. FAULTY OR NON-CONFORMING GOODS
Goods must conform to the contract, be as described, fit for purpose and of satisfactory quality as required by law. Consumers may have rights to a refund, repair, replacement or price reduction under the Consumer Rights Act 2022 and other applicable law. Nothing in these terms limits those rights.
8. CUSTOM AND MADE-TO-ORDER GOODS
Custom-branded, personalised or made-to-order goods may not be cancelled or returned for change of mind once production has begun, where permitted by law. This does not affect rights relating to faulty, damaged or incorrectly supplied goods.
9. BUSINESS AND ORGANISATIONAL CUSTOMERS
If you purchase wholly for business, trade or professional purposes, consumer cooling-off rights may not apply. Any quotation, purchase order or separately agreed written terms may supplement these terms. If there is a conflict, the separately agreed written terms take priority for that order.
10. INTELLECTUAL PROPERTY
The Store and its content, including text, graphics, photographs, branding and layout, are owned by or licensed to School Fitness Ireland and are protected by intellectual property law. You may use the Store for personal or internal purchasing purposes only. You may not reproduce, sell, publish or commercially exploit its content without permission.
11. THIRD-PARTY SERVICES AND LINKS
The Store may use or link to third-party services, including Shopify and payment or delivery providers. Their own terms and privacy notices may apply. We are not responsible for third-party websites that we do not control.
12. LIABILITY
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or your mandatory statutory rights.
Subject to that, we are not liable for losses that were not reasonably foreseeable when the contract was formed. Where you purchase as a consumer, we supply products for private use and are not responsible for business losses. Different limitations may apply to business customers only to the extent permitted by law.
13. EVENTS OUTSIDE OUR CONTROL
We are not responsible for delay or failure caused by events outside our reasonable control. We will take reasonable steps to minimise the effect and will contact you where your order is materially affected. Your statutory rights remain unaffected.
14. CHANGES TO THESE TERMS
We may update these terms from time to time. The terms in effect when your order is accepted will apply to that order, unless a change is required by law.
15. GOVERNING LAW
These terms are governed by Irish law. If you are a consumer resident elsewhere in the European Economic Area, you also retain any mandatory protections available under the law of your country of residence. Irish courts have jurisdiction, without depriving consumers of rights to bring proceedings in another court available under mandatory law.
